Terms and Conditions (T&C)
1. Overview
Welcome to the till5am Games Shop! The terms “we”, “us” and “our” refer to till5am Games Shop, operated by till5am Games GbR, Schmale Allee 9, 53347 Alfter, Germany.
We operate this online shop, including all information, content, functions, products, and services, to provide you with a curated shopping experience (“Services”). The shop is powered by Shopify, which provides us with the technical infrastructure.
These Terms and Conditions (T&C) govern the use of our shop and define the rights and obligations of you as the customer and us as the provider.
By using our shop, you agree to these T&C and our Privacy Policy.
2. Access and Customer Account
By using our shop, you confirm that you are at least 18 years old or have the consent of your legal guardians.
For orders, you may need to provide certain information such as your email address, billing and shipping address, and payment details. You agree to provide accurate and complete information at all times.
You are responsible for keeping your login details confidential and for not sharing them with third parties.
3. Products and Presentation
We make every effort to display our products as accurately as possible. However, variations in color or appearance may occur due to different devices and settings.
Product descriptions and prices are subject to change without prior notice. We may remove products from our range or limit the quantity available per customer.
4. Orders and Contract Formation
By placing an order, you make a binding offer to purchase. A contract is only concluded once we explicitly confirm your order by email.
If products are unavailable, we will inform you immediately. Any payments already made will be refunded without delay.
You may only purchase our products for private use, not for commercial resale.
5. Prices and Payment
All prices are final prices in euros and include the applicable VAT. Shipping costs are shown separately.
The available payment methods are displayed during the order process. You agree to provide up-to-date and correct payment details at all times.
6. Shipping and Delivery
Delivery is made to the address provided by you. Delivery times are non-binding estimates.
The risk of accidental loss does not pass to you until the goods are handed over to you (§ 446 German Civil Code – BGB).
7. Right of Withdrawal
As a consumer, you have a statutory right of withdrawal of 14 days in accordance with §§ 312g, 355 BGB (German Civil Code). Details are set out in our Withdrawal Policy.
The right of withdrawal does not apply to, among others, sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed, as well as customized products.
8. Warranty and Liability
Statutory warranty rights apply.
We are fully liable for intent and gross negligence. In cases of simple negligence, we are only liable if material contractual obligations (so-called cardinal obligations) are breached, and liability is limited to foreseeable and typical damages.
Liability under the Product Liability Act and for damages resulting from injury to life, body, or health remains unaffected.
9. Copyright and Intellectual Property
All content in the shop, including texts, images, logos, and designs, is protected by copyright. Any use without our express written consent is prohibited.
10. Third-Party Tools and Links
Our shop may include services or links provided by third parties. We are not responsible for the content or conditions of such third-party services. Please review the terms of use of third-party providers before engaging with them.
11. Data Protection
The collection and processing of your personal data is governed by our Privacy Policy, which you can view at any time on our website.
12. Feedback
If you provide us with feedback or reviews, we may use this information anonymously for marketing purposes.
13. Final Provisions
If individual provisions of these T&C are invalid, the validity of the remaining provisions shall not be affected.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of the country in which you usually reside remain unaffected.
The place of jurisdiction, as far as legally permissible, is our business location.
